Patna High Court

Sikander Ansari @ Sikandar AlamversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied regular bail to the petitioner, finding the gravity of the offences sufficient to refuse bail.

Summary

The petitioner, Sikander Ansari, was charged with offences under sections 126(2), 118(2), 109(1), 103(1) and 3(5) of the Bihar Non‑Compulsory Statutes (BNS) for allegedly stabbing the husband of an informant, resulting in his death. He applied for regular bail, arguing that he had been in custody since 22 July 2025. The Court examined the seriousness of the alleged murder and the petitioner’s role as an assailant, and found the gravity of the offence warranted denial of bail. Consequently, the bail petition was rejected. However, the Court directed the trial court to expedite the trial and conclude it within one year of the order. The decision underscores the Court’s emphasis on ensuring swift justice in serious criminal matters while denying pre‑trial liberty where the offence is grave.

Issues considered

  • What is the appropriateness of granting regular bail to an accused involved in a murder‑related offence under the BNS?
  • Whether the seriousness of the alleged offences justifies denial of bail.

                                2. Petitioner seeks bail in a case registered for the

                   offence punishable under section 126 (2), 118 (2), 109 (1), 103

                   (1) and 3 (5) of BNS.

                                3. As per F.I.R. this petitioner along with other co-

accused persons assaulted on the neck and chest of the husband

of informant ( deceased) by means of knife, as a result of which,

                   husband of informant died.

                                4. Considering the fact that petitioner appears to be

one of the assailants, materials available on record and gravity

of offence, prayer for regular bail of the petitioner is rejected.

However, since petitioner is in custody since 22.07.2025 ,

learned Trial Court is directed to expedite and conclude the trial,
