MD BABERversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with a bond and specific conditions, including a monthly payment of Rs. 3,000.

Summary

The petitioner, Md Baber, was arrested in a complaint under Section 498A IPC alleging dowry harassment and torture of his wife, Bibi Kahkashan. He denied the allegations and offered to pay a temporary relief of Rs. 3,000 per month to the complainant. The court, after mediation failed, considered his undertaking and the risk of arrest, and ordered bail on a bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) CrPC and Section 482 CrPC. Conditions included the complainant furnishing her savings account details, the petitioner depositing the monthly amount, and cancellation of bail if two consecutive payments are missed. The bail order also stated that the payment would be subject to any matrimonial or maintenance orders and did not preclude other resolutions.

Issues considered

  • Whether bail should be granted to the accused in a Section 498A dowry harassment case.
  • Whether the petitioner’s undertaking to pay monthly relief can be imposed as a condition of bail.
  • Applicability of Section 438(2) CrPC and Section 482 CrPC in granting bail.
