Holding

Bail is granted to the petitioners subject to bond, sureties and verification of criminal antecedent.

Summary

The petitioners, Sudhir Kumar (driver) and Manoj Kumar (co‑driver), were arrested after 235.140 litres of foreign liquor was seized from their bus. They were charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act and have been in judicial custody since 4 January 2026. The petitioners, who have no prior criminal record, applied for bail. The State opposed the bail. The Court considered the facts, the nature of the offence, and the petitioners’ clean antecedent, and ordered that bail be granted on a bond of Rs 10,000 each with two sureties, subject to verification of any concealed criminal antecedent and compliance with conditions under Section 437(3) of the CrPC and Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the accused in a case under the Bihar Prohibition and Excise (Amendment) Act for possession of foreign liquor
