The court held that anticipatory bail may be granted only if the lower court is satisfied that the matter has been settled and the informant supports the compromise.

Summary

Petitioner Jhalu Sahni (Aditya Kumar) sought anticipatory bail in a case (PS No. 290/2025) alleging offences including extortion, offences under the Bharatiya Nyaya Sanhita, Arms Act, SC/ST Act and POCSO Act. The prosecution alleged that the petitioner demanded rangdari (extortion). The petitioner claimed innocence and asserted that the dispute had been compromised between the parties. The State opposed the bail application. The High Court disposed of the bail application, directing the petitioner to approach the lower court with a compromise petition and stating that anticipatory bail would be granted only if the lower court is satisfied that the compromise is genuine and the informant supports it, subject to a bail bond of Rs.10,000 with two sureties; otherwise the lower court should pass an appropriate order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner pending verification of a claimed compromise in a case involving multiple serious offences.
