The court granted bail to the petitioner, directing him to furnish a bail bond of Rs. 10,000 with two sureties.

Summary

The petitioner, Manoj Kumar Sah, applied for bail in a case registered under Section 309(4) of the BNS concerning the alleged robbery of Rs. 2,60,000. The prosecution alleged that the petitioner was involved in the robbery, while the petitioner claimed innocence, stating that the FIR was lodged against unknown persons and that only a co-accused’s confessional statement implicated him. No tip was conducted, and the co-accused had already been granted bail. The State opposed bail, citing five prior criminal cases against the petitioner. After hearing both sides, the court found the evidence insufficient to justify continued detention and ordered the petitioner to be released on bail with a bond of Rs. 10,000 and two sureties, subject to cooperation with the trial.

Issues considered

  • Whether bail should be granted to the petitioner under Section 309(4) of the BNS given the lack of direct evidence and the existence of a co-accused’s confessional statement.
  • Whether the petitioner’s criminal antecedent of five cases warrants denial of bail.
