Patna High Court

Geeta Devi @ Manisha @ LipstickwaliversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified bond and attendance conditions.

Summary

Geeta Devi, a woman, was arrested on 18‑Nov‑2025 for possession of 7.12 g of smack, alleged to violate Sections 8(c) and 21(b) of the NDPS Act and Sections 111(2) and 3(5) of the Bihar Narcotic Substances Act. She filed a regular bail application before the Patna High Court. The Court noted the intermediate quantity of the drug, the length of her custody, and her gender, and consequently granted bail. She was ordered to furnish a bail bond of Rs 10,000 with two sureties of the same amount, subject to verification of any prior criminal antecedents beyond a 2021 case. Additional conditions required her to attend the Kishanganj Police Station every Sunday, with non‑compliance leading to bail cancellation.

Issues considered

  • What considerations govern the grant of regular bail in NDPS cases involving intermediate quantities of narcotics?
  • Whether the petitioner’s gender and period of custody justify bail despite the alleged offences under the NDPS Act and Bihar Narcotic Substances Act.
