Patna High Court

Sachin KumarversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The Court denied bail, holding that the circumstances, including the recorded confession and prior antecedents, did not warrant the petitioner’s release.

Summary

Sachin Kumar was arrested on 17 September 2025 in connection with a murder case (Bidupur P.S. Case No. 557 of 2025) arising from an FIR dated 27 August 2025. The prosecution alleges that unknown persons fired at the informant’s husband, resulting in his death, and that the petitioner confessed to the crime, with the weapon recovered from his residence. The petitioner contended that he was never named in the FIR and that his name was only linked to the case through a self‑confessional statement recorded in an unrelated industrial case, asserting his innocence and lack of material evidence. The informant and the Additional Public Prosecutor opposed bail, emphasizing the recorded confession, recovery of the weapon, and the petitioner’s two prior criminal antecedents. The Court, after considering the circumstances, refused the bail application, concluding that the petitioner’s liberty should not be enlarged pending trial.

Issues considered

  • Whether bail should be granted to the petitioner in view of the alleged confession and recovery of the weapon
  • Whether the petitioner’s prior criminal antecedents justify denial of bail

petitioner is innocent and he has falsely been implicated in the

present case. He further submits that the petitioner is not named

in the FIR and his name has been transpired during investigation

on the basis of the self confessional statement of the petitioner

which was recorded in Industrial P.S. Case No. 140 of 2025 and

except the aforesaid, no other material has come during

the present occurrence. Apart from that the present FIR has been

instituted on 27.08.2025 and before that the inquest report has

prayer for bail of the petitioner and submits that the petitioner

has confessed his guilt in the present occurrence which was

recorded in paragraph no. 33 of the case diary. Thereafter, on the

basis confessional statement of the petitioner the arms which

was used in present crime in question was also recovered from

the house of the petitioner and the same has been recorded in

paragraph no. 35 of the case diary. Apart from that the petitioner

carries two criminal antecedents other than the present one.

                       6. Considering the aforesaid facts and circumstances
