Holding
The court held that bail could not be granted to the petitioner.
Summary
The petitioner, Ajay Nat, applied for regular bail in a case registered as Mirganj P.S. Case No. 360 of 2025 for an offence under Section 309 of the B.N.S. The prosecution alleged that three unknown persons looted a motorcycle and a mobile phone belonging to an informant, and the petitioner’s name appeared in the confessional statements of co‑accused. The petitioner has been in custody since 20‑09‑2025 and has 29 prior criminal antecedents, all of which are currently on bail. The court examined the petitioner’s alleged involvement, the material evidence against him, and his extensive criminal record. Considering these factors, the bench was not inclined to grant bail. Consequently, the application for regular bail was dismissed.
Issues considered
- Whether regular bail should be granted to the petitioner under Section 309 of the B.N.S. in view of the confessional statements of co‑accused
- Whether the petitioner’s extensive criminal antecedents justify denial of bail
