The court granted bail to the petitioner upon the condition of furnishing a bail bond of Rs. 10,000 with two sureties.

Summary

The petitioner, Parwati Devi, sought bail in a case registered under Sections 419, 420, 467, 468, 34 and 120B of the Indian Penal Code for allegedly fraudulently transferring a matured LIC policy amount of Rs. 15,00,000. The prosecution alleged her involvement in the fraud, while her counsel argued that she is innocent, has no prior criminal record, and is being falsely implicated, citing that co‑accused persons have already been granted bail in similar matters. The State opposed the bail application. After hearing both sides and considering the facts, the court decided to enlarge the petitioner on bail, directing her to furnish a bail bond of Rs. 10,000 with two sureties of the same amount. The bail was granted subject to the satisfaction of the Chief Judicial Magistrate, Nalanda.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under Sections 419, 420, 467, 468, 34 and 120B IPC.
