The Court granted regular bail to the petitioner.

Summary

The petitioner, Subhan Miyan, was charged under Section 309(4) of the Bihar Negotiable Instruments Act for alleged theft of Rs.1,68,873. The prosecution’s case relied solely on a confessional statement of a co‑accused, Md. Juber, which named the petitioner, while no material was recovered from him and no T.I.P. was conducted. The petitioner contended that he was falsely implicated, had no evidence against him, and had been in judicial custody since 25 July 2025. The State opposed bail, highlighting the petitioner’s criminal antecedent of thirteen pending cases. After considering the lack of direct evidence and the similarity of the petitioner’s situation to co‑accused who were previously granted bail, the Court ordered his release on regular bail with a bond and conditions.

Issues considered

  • Whether regular bail can be granted in a case under Section 309(4) of the Bihar Negotiable Instruments Act when the only evidence is a co‑accused’s confessional statement.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
  • Whether the absence of material recovery and a T.I.P. affects the bail decision.
