The Court granted anticipatory bail to the petitioner subject to surrender and bail‑bond conditions.

Summary

Pankaj Kumar Shrivastav applied for anticipatory bail fearing arrest in Cyber P.S. Case No. 132 of 2025, which alleges offences under Sections 319(2), 318(4), 338, 336(3), 316(2) and 61(2) of the B.N.S. and Sections 66C and 66D of the Information Technology Act. The prosecution’s case is based on a complaint lodged on the Pratibimb portal linking a mobile number to co‑accused Sandeep Kumar, who in turn named Ashik Jamal, who subsequently identified nine persons including the petitioner. The petitioner contended that he is innocent, that the only basis for his implication is the confessional statement of Sandeep Kumar, and that no cyber‑fraud proceeds have entered his account. The State opposed bail, highlighting the petitioner’s two prior criminal cases. After hearing both sides, the Court granted anticipatory bail, directing the petitioner to surrender within four weeks and to furnish a bail bond of Rs 10,000 with two sureties, subject to the conditions of Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail can be granted in a cyber‑offence case where the primary evidence is the statement of a co‑accused
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail
  • Whether the allegations under the B.N.S. and IT Act satisfy the criteria for denial of bail under Section 482(2) of the B.N.S.S.
