Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, MD Imtiyaz Alam, filed an application for anticipatory bail after learning that he was named in an FIR for alleged assault with a knife on an informant, along with co‑accused Tanvir Alam. The prosecution alleged that the assault caused multiple injuries, including a grievous one, and cited several sections of the Indian Penal Code. The petitioner contended that he was innocent and was falsely implicated due to village politics. The State opposed the bail, emphasizing the specific and direct nature of the accusations, the seriousness of the injuries, and the petitioner’s two prior criminal convictions. After considering these factors, the Court rejected the petition for anticipatory bail, concluding that the circumstances did not warrant such relief.
