Holding

The Court held that bail could not be granted and dismissed the bail application.

Summary

The petitioner, Ravi Kishan Kumar, applied for regular bail in a case registered as Sheohar P.S. Case No. 263 of 2025, involving offences under Sections 103(1), 303(2) and 238 of the BNS. The prosecution alleged that unknown persons killed the deceased and that the petitioner’s name appeared in a statement of another accused, with forensic items such as blood‑stained clothing recovered. The petitioner had been in custody since 29 July 2025. The Court, noting the brutal nature of the killing and the material evidence linking the petitioner, declined to grant bail. The application was dismissed, with a direction that the petitioner may re‑apply for bail if the trial is unduly delayed, and the Court clarified that its observations were limited to the bail application and not on the merits of the case.
