Patna High Court

Pujit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for anticipatory bail, granting it subject to a bail bond and sureties.

Summary

The petitioner, Pujit Kumar, feared arrest in a case (PS Kalyanpur, Case No. 217 of 2023) involving offences under Sections 341, 323, 324, 379, 354, 504, 506 and 34 of the IPC. The FIR alleges that co‑accused Ankit Kumar assaulted the informant and his wife, and the petitioner is only said to have taken the side of Ankit Kumar, with no direct allegation of assault against him. The petitioner, claiming innocence and clean antecedents, applied for anticipatory bail, which the State opposed. The Court, after considering the general nature of the accusations and the petitioner's clean record, granted anticipatory bail, directing a bail bond of Rs.10,000 with two sureties of the same amount, subject to Section 482(2) of the B.N.S.S. The order applies if the petitioner is arrested or surrenders within eight weeks from the date of the order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the allegations under multiple IPC sections
  • Whether the petitioner’s alleged support to the co‑accused constitutes a cognizable offence warranting denial of bail
