The court granted regular bail to the petitioner.
Summary
The petitioner, Md. Kosher, sought regular bail in a case registered under Sections 191(2), 191(3) and 103(1) of the BNS, alleging that he and 15 others assaulted the brother of an informant with a stick and brick, leading to the victim's death en route to a hospital. The prosecution argued that the assault caused fatal injuries, while the petitioner’s counsel contended that the allegations were general, the injuries were superficial, and the cause of death was haemorrhage and shock. The petitioner had been in judicial custody since 12 September 2025. After hearing both sides, the court found the allegations insufficiently specific and the injuries not indicative of a grave offence, and therefore ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties. The bail was granted subject to satisfaction of the Chief Judicial Magistrate, Khagaria.
Issues considered
- Whether the petitioner is entitled to regular bail despite charges of assault causing death under Sections 191(2), 191(3) and 103(1) of the BNS
- Whether the allegations against the petitioner are sufficiently specific to deny bail
- Whether the nature of the injuries sustained by the deceased justifies denial of bail
