Anticipatory bail was denied to petitioner No.2 but granted to petitioners 1, 3, 4 and 5 subject to conditions.
Summary
The petitioners, five members of the Yadav family, filed an anticipatory bail application fearing arrest in a case registered under multiple sections of the Indian Penal Code for alleged assault on an informant and his relatives. They contended that the incident arose from a long-standing land dispute and that the accusations were vague and omnibus, with no specific overt act attributed to them. The State opposed the bail, asserting that the FIR specifically named the petitioners and that petitioner No.2 caused grievous injuries. The High Court examined the specificity of the allegations and the nature of injuries, rejecting anticipatory bail for petitioner No.2 while granting it to petitioners 1, 3, 4 and 5 subject to a bail bond and sureties under Section 482(2) of the CrPC. The application was consequently disposed of with the stated directions.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under the circumstances of the case
- Whether the specificity of the accusation against petitioner No.2 justifies denial of anticipatory bail
- Whether the general and omnibus nature of the accusations against petitioners 1,3,4,5 warrants grant of anticipatory bail

father. Injuries caused by Petitioner No. 2 is grievous in nature.
6. Considering the facts and circumstances of the
