Decided

BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Aakesh Das, sought anticipatory bail fearing arrest in a case (PS Silao, Case No. 352 of 2025) alleging offences under Sections 115(2), 126(2), 190, 191(2), 109(1), 74, 303(2), 351(3) and 352 of the B.N.S. The prosecution alleged that the petitioner assaulted Ishwar Das with an iron rod. The petitioner contended that he was falsely implicated due to a land dispute, that the injuries were minor, and that he has a clean antecedent. The State opposed the grant of anticipatory bail. Considering the nature of the alleged injuries, the petitioner’s clean record, and the circumstances of the case, the Court allowed anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties, subject to Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious charges listed under the B.N.S.
  • Whether the petitioner poses a flight risk or threat to the investigation
  • Whether the allegations stem from a false implication related to a land dispute
