Holding

The court granted regular bail to the petitioner.

Summary

Manish Bind petitioned for regular bail in a case registered under multiple sections of the B.N.S., alleging that he and four others assaulted the son of an informant, resulting in the victim's death. The prosecution alleged that the accused were armed with lathis, dandas and sharp weapons and caused fatal injuries. The petitioner claimed innocence, asserted a counter‑version of events, highlighted injuries to both parties, and pointed out the lack of specific allegations linking him to any particular weapon, as well as his clean criminal record and the prior bail granted to a co‑accused. The State opposed the bail on the seriousness of the offences. After hearing both sides, the Patna High Court found the petitioner's circumstances comparable to the co‑accused and ordered his release on regular bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with serious offences including murder and assault.
  • Whether the allegations against the petitioner are sufficiently specific to deny bail.
  • Whether the grant of bail to a co‑accused influences the bail decision for the petitioner.
