Patna High Court

Mantu KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted as no fresh ground was shown and the offences are of a grave nature.

Summary

Mantu Kumar was arrested in connection with a murder case (PS Roshanganj Case No.49 of 2025) and charged under Sections 103(1), 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27(3) of the Arms Act. He applied for regular bail, which was first denied by the Patna High Court on 25 June 2025, the court finding no fresh ground and noting the seriousness of the offences. The petitioner filed a second bail application, arguing that circumstances had changed. The court, after hearing counsel, held that the allegations remained grave, no new material was presented, and therefore the earlier decision stood. Consequently, the bail application was dismissed and the trial court was directed to frame charges promptly.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under the B.N.S. and Arms Act
  • Whether any fresh ground exists to merit a review of the earlier bail denial

am not inclined to review my earlier order. Accordingly, this

bail application is dismissed. The trial court is directed to frame

the charge in the case at the earliest.
