Patna High Court

Devendra YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner, subject to bond, sureties, and conditions, as he was not named in the FIR and no recovery was made from him.

Summary

The petitioner, Devendra Yadav, was apprehended after police recovered 72.11 grams of a smokelike substance from a Swift Dzire registered in his name, though the substance was found in the possession of a co-accused. The FIR, however, names only Debesh Kumar alias Madhav, and no direct recovery was made from Yadav. Yadav, who has no prior criminal record, applied for bail, arguing that he is not an accused in the FIR. The State opposed the bail, citing the seriousness of the NDPS offences. The Court, noting the lack of direct incriminating evidence against Yadav and his clean record, granted bail subject to a bond, sureties, and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, requiring his cooperation with the investigation and trial.
