Holding
The Court granted bail to the petitioner, directing the execution of a bail bond with two sureties.
Summary
Krishna Nat (alias Chhotu Kumar) was arrested in connection with a case registered under multiple sections of the B.N.S. and Section 27 of the Arms Act, alleged to have fired at the informant's son without causing injury and with no weapon recovered. The petitioner contended that he was innocent, had no criminal antecedents, and had been in judicial custody since 3 December 2025. The State opposed the bail application, arguing the seriousness of the charges. The Court examined the facts, noting the lack of injury, absence of a weapon, and the petitioner's clean record. Consequently, the Court ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount, subject to the satisfaction of the Chief Judicial Magistrate, Sasaram.
Issues considered
- Whether bail should be granted to the petitioner despite the serious nature of the charges under the B.N.S. and the Arms Act
- Whether the absence of injury, lack of a recovered weapon, and the petitioner's clean record justify bail
