The court granted regular bail to the petitioner.

Summary

The petitioner, Ranveer Kumar, sought regular bail in a case under Sections 25(1‑B)(a), 26 and 35 of the Arms Act, alleging that he was falsely implicated and that no contraband was recovered from his possession. The prosecution alleged that during a night patrol on 30‑09‑2025 the petitioner was apprehended after fleeing from police and that a pistol, a mobile phone and a bike were seized from him. The petitioner contended that the seizure was not made in compliance with Section 105 of the Bihar Non‑Statutory Seizure (BNSS) Act, he has no prior criminal record, and a co‑accused, Lalu Kumar, had been granted bail in a similar case. The State opposed the bail application. After hearing both sides, the court found merit in the petitioner's arguments, noted the similarity to the earlier bail order, and directed that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Arms Act provisions.
  • Whether the seizure of the alleged weapon complied with Section 105 of the BNSS Act.
  • Whether the prior bail granted to a co‑accused warrants similar relief for the petitioner.
