Patna High Court

Harendra Yadav @ Harendra Ray @ Harendra PrasadversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

A modification petition filed after the prescribed surrender period cannot be entertained and must be rejected.

Summary

The petitioner, Harendra Yadav, sought modification of an anticipatory bail order dated 24‑09‑2025, which required him to surrender within four weeks. He filed the modification petition on 25‑02‑2026, more than five months after the surrender deadline, claiming there was no bail‑bond document. The court examined whether a petition for modification filed outside the stipulated period could be entertained. It held that the petition was filed well beyond the four‑week window and therefore could not be granted. Consequently, the court rejected the request for modification of the anticipatory bail.
