Md. SalmanversusThe State of Bihar

Holding

The court granted regular bail to the petitioner.

Summary

Md. Salman, originally an informant in a cyber‑fraud case, was later implicated as an accused under IPC sections 319, 318(4) and 111 and IT Act section 66(D) based largely on the confessional statements of co‑accused Abhimanyu Kumar and Rahul Kumar. The petitioner claimed innocence, asserted no prior criminal record, and had been in judicial custody since 19 November 2025. The State opposed regular bail, arguing the seriousness of the offences. After hearing both sides, the Patna High Court found that the circumstances warranted bail and ordered the petitioner’s release on a bail bond of Rs 10,000 with two sureties. The bail order was directed to be executed by the Khagaria Judicial Magistrate.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the nature of the offences under IPC and the IT Act.
  • Whether the confessional statements of co‑accused are sufficient to deny bail to the petitioner.
