Patna High Court

Nitish KumarversusThe State of Bihar through Vigilance Unit Patna

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Nitish Kumar was arrested on 1 November 2025 in connection with an FIR dated 31 October 2025 alleging that he demanded a Rs.1 lakh bribe, an offence punishable under Section 7(a) of the Prevention of Corruption Act, 1988. The petitioner claimed he has a clean antecedent and that the FIR is false, noting that the recovery of the alleged bribe money was made from the co‑accused, Devendra Kumar, and that no evidence directly implicates him. The Vigilance Unit opposed his bail, but the court considered his clean record, the fact that the recovery was from the co‑accused, and the submission of a charge sheet. The court therefore granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, physical presence, and non‑tampering with evidence or witnesses. The bail order also directed verification of the petitioner’s criminal antecedent, with cancellation provisions if false information is discovered.
