The court held that the petitioner is entitled to anticipatory bail, subject to specified conditions, despite the seriousness of the allegations and his prior criminal record.

Summary

Petitioner Prakash Kumar Raja applied for anticipatory bail in connection with a criminal case (PS No. 182/2024) alleging offences under several IPC sections including kidnapping and extortion. The prosecution alleged that the petitioner, along with others, abducted the brother of an informant and demanded a Rs.5 lakh ransom. The petitioner contended he was not named in the victim’s statement under Section 164 CrPC and asserted his innocence, while the State highlighted two prior criminal antecedents. After hearing both sides, the High Court granted anticipatory bail, directing the petitioner to surrender within four weeks and to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the CrPC. The order reflects the court’s view that the allegations, though serious, do not preclude bail pending further investigation.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the serious nature of the alleged offences.
  • Whether the presence of prior criminal antecedents bars the grant of anticipatory bail.
  • Whether the allegations constitute a non-bailable offence that warrants denial of bail.
