Holding

The court granted bail to the petitioner, finding no justification for continued detention.

Summary

The petitioner, Pintu Ram, was charged under several sections of the B.N.S. and the Arms Act for allegedly firing a weapon that injured an informant. He claimed he was falsely implicated and has been in custody since 28-09-2025. A counter case filed by his wife against the informant was noted, and the informant had not alleged any motive against the petitioner. The charge sheet had been filed and cognizance taken, indicating that the investigation was complete. The court, after considering these facts, granted bail on a bond of Rs. 10,000 with two sureties, releasing the petitioner.

Issues considered

  • Whether bail should be granted to the petitioner under the charged offences.
  • Whether the filing of the charge sheet and taking of cognizance precludes further detention.
  • Whether the existence of a counter case and lack of motive allegation affect bail eligibility.
