The Court granted bail to all petitioners on the condition of a Rs 10,000 bond with two sureties each.
Summary
The petitioners, a group of 26 individuals from villages in Rohtas district, were charged under Sections 191(2), 191(3), 190, 121(1), 121(2), 324(5), 132 and 109 of the Indian Penal Code for allegedly attacking a police station during a land‑dispute related law‑and‑order operation on 13 July 2025. The prosecution alleged that about 200 persons assaulted the police station and the informant, causing only simple injury. The petitioners contended they were falsely implicated, that the FIR named only 50 persons in a general and omnibus manner, and that similarly situated co‑accused had already been released on bail in other cases. The State opposed the bail application. After hearing both sides, the Court found the allegations insufficient to justify continued detention and ordered that all petitioners be released on bail upon furnishing a bond of Rs 10,000 each with two sureties.
Issues considered
- Whether the petitioners are entitled to bail despite the serious nature of the offences alleged under the IPC.
- Whether the general and omnibus nature of the FIR and the simple injury to the informant justify bail.
- Whether the grant of bail to similarly situated co‑accused in other cases is determinative.
