Holding

The application for anticipatory bail was dismissed.

Summary

Jaymanti Devi, the petitioner, feared arrest in connection with a 2019 case (Case No. 119) involving alleged murder under Sections 302/34 of the IPC, possession of arms under Section 27 of the Arms Act, and offences under Sections 17, 18, 20, 23 of the Uttar Pradesh Act. The prosecution alleged she was a Naxal participant in the killing, and her name appeared in a co‑accused’s self‑incriminatory statement. She filed an application seeking protection from arrest, likely anticipatory bail. The court examined the allegations and found sufficient material linking her to the offences, and therefore dismissed the application. The petitioner was ordered to surrender within four weeks and to apply for regular bail, with the Superintendent of Police directed to effect her arrest.
