Patna High Court

Rakesh Kumar @ RokiversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner on account of the inordinate delay in trial.

Summary

Rakesh Kumar was arrested in May 2023 for alleged murder under Sections 302, 120(B) and 34 of the IPC and for offences under the Arms Act. He remained in custody for over two years, during which the trial progressed slowly; only two of seventeen witnesses had been examined and none for the last six months. The petitioner filed his third application for regular bail, arguing that the delay violated his right to a speedy trial. The court examined the prosecution’s case and considered the seriousness of the charges against the extent of the delay. Finding the delay inordinate and unjustified, the court allowed the bail application, directing a bail bond of Rs 10,000 with two sureties and imposing conditions of regular police‑station attendance and cooperation with the trial. The order also warned that non‑compliance would lead to cancellation of bail.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with murder and arms offences
