The court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Ashutosh Kumar, was arrested in connection with a robbery and shooting incident alleged under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that unknown assailants robbed the informant and a villager, Manilal Yadav, and shot both, seizing large sums of money. The petitioner claimed innocence, stating that the FIR was lodged against unknown persons and that only a co-accused's confessional statement implicated him, with no material recovered from his possession. He also highlighted his six prior criminal cases and his detention since 23‑11‑2025, seeking regular bail. The court, after considering the seriousness of the offence and the petitioner’s antecedents, granted bail on condition of a Rs.10,000 bond, two sureties, regular court appearances, and weekly police station attendance.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious nature of the offences under IPC s.394 and Arms Act s.27 and his prior criminal antecedents.
