Patna High Court

Krishna SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the allegations were prima facie general and omnibus, and therefore granted bail to the petitioner.

Summary

Krishna Sah was arrested in connection with a dowry harassment case (Section 498A IPC and Section 4 of the Dowry Prohibition Act) where the FIR alleged physical and mental cruelty towards his daughter for non‑payment of dowry. The petitioner contended that the allegations were vague, general and filed falsely, and he sought bail. The Additional Public Prosecutor opposed bail. The High Court observed that the allegations of cruelty and dowry demand were prima facie general and omnibus, and therefore not sufficient to justify continued detention. Consequently, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to the conditions of Section 482(2) of the CrPC. The bail order was directed to be implemented by the Sub‑Divisional Judicial Magistrate, Siwan.

Issues considered

  • Whether the allegations of dowry demand and cruelty are sufficient to deny bail under the CrPC
