The court granted regular bail to the petitioner.

Summary

The petitioner, Sunil Agrawal, sought regular bail in a criminal case (PS Case No. 379 of 2025) alleging offences under Sections 103(1), 238(1) and 3(5) of the BNS. The prosecution alleged that the deceased, wife of Priyam Agrawal, was strangulated and that the petitioner, along with others, fabricated a suicide. The petitioner’s counsel argued that the FIR only implicates the husband in a matrimonial dispute and that there is no direct allegation against the petitioner, who is the father‑in‑law and has been in judicial custody since 14‑12‑2025. The State opposed bail. Considering the facts, the court found no substantive basis to deny bail and ordered the petitioner’s release on a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted to the petitioner despite allegations of involvement in a homicide disguised as suicide under Sections 103(1), 238(1) and 3(5) of the BNS.
