Patna High Court

Kranti KumarversusThe State of Bihar

Decided

Holding

The Court granted regular bail to the petitioner with conditions of cooperation and attendance.

Summary

Kranti Kumar was arrested in connection with a robbery at gunpoint where Rs.1,500 and a mobile phone were taken from an informant. The only link to him is a confessional statement made by co‑accused Chandan Kumar; no material was recovered from his possession and no TIP was conducted. He has been in judicial custody since 26‑09‑2025 and the State highlighted six prior criminal cases against him. The petitioner sought regular bail, arguing the lack of substantive evidence beyond the confessional statement. The Court, considering the circumstances and the petitioner’s willingness to cooperate, granted regular bail on the condition of attendance at trial and a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the reliance on a co‑accused's confessional statement.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
