Patna High Court

Vikesh Kumar @ Bikesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Vikesh Kumar, applied for regular bail in a case alleging his assistance in facilitating a co-accused's illegal entry into India using a fake passport, under sections 318(4), 61 and 3(5) of the B.N.S. The prosecution argued he was an abettor, while the petitioner claimed innocence, clean antecedent, and that only a personal mobile phone was recovered. The State opposed bail. The court noted that the co-accused had already been granted regular bail by a co‑ordinate bench and that the petitioner had no prior criminal record. Considering these factors, the court ordered bail on a bond of Rs.10,000 with two sureties. The application for bail was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite alleged abetment of illegal entry.
  • Whether the grant of bail to the co‑accused and the petitioner's clean antecedent justify bail.
