Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified conditions.

Summary

Murari Kumar Singh was arrested in connection with a case under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for possession of 9.06 grams of smack. The petitioner claimed innocence, asserted that he had been falsely implicated, and disclosed four prior criminal antecedents while having been in custody since 1 January 2026. The State opposed regular bail, citing the nature of the offence and the petitioner’s antecedents. The Court, after considering the intermediate quantity of narcotics and the circumstances, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to appear at the police station every Sunday. Failure to comply with the attendance condition would result in cancellation of the bail.

Issues considered

  • Whether bail should be granted in an NDPS case involving an intermediate quantity of narcotics and the accused’s prior criminal antecedents
  • Whether the conditions imposed by the Court are appropriate for ensuring the accused’s attendance
