Patna High Court

GOLDI @ ASHISH RANJANversusTHE STATE OF BIHAR

Decided

Holding

The court granted regular bail to the petitioner, directing his release on a bond of Rs.10,000 with two sureties.

Summary

The petitioner, Goldi @ Ashish Ranjan, was charged under Sections 109(1) & 3(5) of the Bihar Narcotic Substances Act, Sections 3 & 4 of the Explosive Substance Act and Section 103(1) of the same Act for allegedly throwing a bomb during an examination at B.N. College, Patna, which resulted in a student’s death. The petitioner claimed innocence, asserting an alibi that he was attending an exam at the College of Commerce at the relevant time, and argued that the only incriminating material was the confessional statement of another accused, Prakash Chandra Prabhat. The State opposed bail, highlighting three prior criminal cases against the petitioner. After hearing both sides, the court found the alibi and lack of independent evidence persuasive and, despite the antecedents, ordered the petitioner’s release on regular bail upon furnishing a bond of Rs.10,000 with two sureties. The application for bail was therefore allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with serious offences under the Bihar Narcotic Substances Act and the Explosive Substance Act.
  • Whether the alibi and the absence of evidence beyond a confessional statement of another accused justify granting bail.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
