The Court denied anticipatory bail to the petitioner.
Summary
The petitioner, Ganauri Ram, filed an anticipatory bail application fearing arrest in connection with a 2024 FIR (Case No. 42) that alleged his involvement in multiple offences under the Indian Penal Code, including rioting, assault, grievous hurt, and outraging the modesty of women. The prosecution’s version, based on the informant’s statement and a medical injury report, claimed that Ram struck the informant’s brother-in-law, Anuj Yadav, with an iron rod, causing a fractured hand, and that other accused assaulted the daughter‑in‑laws. The petitioner contended that the case was fabricated, that there were numerous accused to implicate everyone, and that an earlier case pre‑existed the present FIR. The State’s counsel countered that the FIR specifically named Ram for the assault and that the injury report corroborated the allegation. After considering the specific allegation and supporting medical evidence, the Court found no ground to grant bail. Consequently, the anticipatory bail application was rejected.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in view of the specific allegations and supporting medical evidence.
