Decided

DISMISSED

Holding

Regular bail is not granted to the petitioner.

Summary

The petitioner, Sonu Kumar, applied for regular bail in a case registered under Sections 103(1), 351(3), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act, alleging his involvement in a homicide. The prosecution alleged that the petitioner, along with others, killed the deceased and presented prima facie material linking him to the crime. The petitioner has been in custody since 27‑08‑2025 and has three prior criminal antecedents. The Court observed that the nature and gravity of the offences, coupled with the petitioner’s antecedents, warranted denial of bail. Consequently, the application for regular bail was dismissed, with the Court noting that its observations are limited to the bail application and do not prejudice the trial.
