The Court allowed the application for regular bail, directing the petitioner’s release on bond.
Summary
The petitioner, Harsh Raj, a Mathematics (Hons.) student, was arrested on 19‑08‑2025 in connection with a case registered under multiple IPC sections (147, 148, 149, 341, 323, 307, 504, 506) and Section 27 of the Arms Act, alleging assault. He applied for regular bail, claiming innocence, while the State opposed the relief. The Court considered the nature of the allegations, the period of custody, and the petitioner’s student status. It concluded that bail could be granted despite the serious charges, emphasizing that the order was prima facie and not a comment on the merits. Accordingly, the petitioner was released on bail upon furnishing a Rs.10,000 bond with two sureties of the same amount.
Issues considered
- Whether regular bail should be granted to the petitioner despite the seriousness of the offences alleged under the IPC and Arms Act
- Whether the petitioner’s status as a student and the period of custody justify bail
