Holding
Bail was granted to the petitioner as the evidence against him was limited to a co‑accused’s confessional statement and did not establish a prima facie case.
Summary
The petitioner, Ravi Ranjan, was arrested in connection with a murder case (PS Case No. 475 of 2025) alleged under Sections 103(1) and 61(2) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The prosecution's case is that the victim was killed after being threatened for exposing corruption, and that the petitioner acted as a "liner" who identified the victim to the main accused. The only material linking the petitioner to the crime is the confessional statement of co‑accused Nazare Alam, which describes the petitioner merely as a lookout and does not provide direct evidence of participation. The defense argued that there is no FIR mention of the petitioner and no other corroborative evidence, warranting bail. After considering the submissions, the court held that the petitioner’s role was limited to that of a liner and, in the absence of substantive proof, he should be released on bail upon furnishing a bond and sureties.
Issues considered
- What is the adequacy of the confessional statement of a co‑accused as the sole basis for denying bail?
- Whether the petitioner’s alleged role as a "liner" justifies continued detention under Sections 103(1), 61(2) of B.N.S. 2023 and 27 of the Arms Act.
