Holding

The Court granted bail to the petitioner despite the confessional statement.

Summary

The petitioner, Satyendra Kumar, was arrested in connection with the murder of Pinki Kumari, alleged under Sections 103(1) and 3(5) of the B.N.S. The FIR did not name him, but a mobile CDR showed he had spoken with the deceased, and a confessional statement was later extracted in which he admitted participation in the killing. The petitioner argued that apart from the confessional statement there was no other incriminating evidence and that he had no prior criminal record. The State opposed bail, emphasizing the seriousness of the offence and the confession. The Court, after considering the circumstances, ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the satisfaction of the Chief Judicial Magistrate.

Issues considered

  • Whether bail can be granted when the only evidence against the accused is a confessional statement.
  • Whether the absence of the petitioner’s name in the FIR and lack of prior criminal antecedent justify bail.
