The anticipatory bail application was rejected.

Summary

The petitioners, Janardan Singh and his wife Parvati Devi, sought anticipatory bail under Section 80 read with Section 3(5) of the B.N.S. after being implicated in a dowry harassment case that allegedly led to the suicide of the informant's daughter. The prosecution alleged that the petitioners, along with others, repeatedly beat and threatened the daughter for dowry, culminating in her being driven out of the house and eventually committing suicide. The petitioners contended they were innocent, denying any demand for dowry or involvement in the victim's death, and argued that the allegations were vague and omnibus. The State opposed the bail, emphasizing the seriousness of the alleged offences. Considering the gravity of the accusations, the court declined to grant anticipatory bail and dismissed the application.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Section 80 r/w Section 3(5) of the B.N.S. in view of the alleged dowry harassment and suicide.
  • Whether the allegations against the petitioners are sufficient to deny anticipatory bail.

2 28-01-2026 Heard learned counsel for the petitioners and learned

                   A.P.P. for the State.

                                2. The petitioners apprehend their arrest in connection

with Kochas P.S. Case No. 237 of 2025, registered for the

offence punishable under Section 80 r/w Section 3(5) of the

                   B.N.S.

                                3. The case of the prosecution, in short, is that the

marriage of the informant’s daughter was solemnized in the year

2024 with the petitioners’ son. A few months after the marriage,

the petitioners along with other co-accused persons used to beat

and threaten her in the name of dowry. Panchayat was held

again and again but people used to tell her daughter that unless

she asks for two lakh rupees as dowry she will continue to be

beaten. One day, all accused persons named in the FIR had

beaten her daughter badly and driven her out of the house and

said that we won't keep her unless she pay Rs. 2,00,000/-. The

informant borrowed one lakh rupees from relative and give it to

her daughter's in-laws to accommodate her daughter at her in

law's house. On 17.09.2025 at about 6:30 P.M., the informant

received an information from the Kochas Police Station that her

daughter had committed suicide by hanging herself from a

ceiling fan and when they arrived, they found her daughter’s

body at Sadar Hospital, Sasaram for post mortem and cause of

death is Asphyxia due to hanging.

                       4. Learned counsel for the petitioners submits that the

petitioners are innocent and have falsely been implicated in the

present case. The petitioners have neither demanded any dowry

nor assaulted or tried to kill the victim. The allegations levelled

against the petitioners are general and omnibus in nature.

                       5. Learned A.P.P. for the State opposes the prayer of

          anticipatory bail.

                       6. Considering the nature and gravity of the offence

alleged to have been committed by the petitioners, this Court is

not inclined to grant privilege of anticipatory bail to the
