Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Reyaz Ahmad, was arrested in connection with the murder of an informant’s wife and the alleged concealment of cash and jewellery taken by the principal accused, Saif Ali. The prosecution alleged that the deceased was killed under suspicious circumstances and that the stolen items were hidden in the petitioner’s furniture shop. Saif Ali, who was apprehended, gave a confessional statement implicating himself in the murder and stating that he had hidden the loot in the petitioner’s shop. The petitioner’s counsel argued that he had no role in the homicide, possessed no criminal antecedent, and was falsely implicated, seeking regular bail. The State opposed the bail application, contending the petitioner’s involvement in the concealment of stolen property. After considering the evidence and the confessional statement, the Court granted regular bail on a bond of Rs.10,000 with two sureties.
