Patna High Court

Ram Bilash Mandal @ Rambilash kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, notwithstanding the serious nature of the offences, the petitioner’s right to liberty and the circumstances of prolonged pre‑trial detention warranted the grant of regular bail on a bond with sureties.

Summary

The petitioner, Ram Bilash Mandal, was arrested in connection with a 2021 FIR alleging dowry demand, torture, assault and a second marriage, and was charged under sections 498A, 494, 323, 506, 34 of the IPC and sections 3 and 4 of the Dowry Prohibition Act. He contended that the allegations were false, that he had no prior criminal record, and that the case stemmed from a matrimonial dispute in which he had filed a suit for restitution of conjugal rights. He had been in custody since 26‑11‑2025 and a chargesheet had been filed. The State opposed his bail application. After hearing both sides, the court considered the seriousness of the charges, the petitioner’s lack of antecedents, the prolonged pre‑trial detention and the pending matrimonial suit, and ordered that he be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the accused in a case involving offences under the IPC and the Dowry Prohibition Act.
  • Whether the petitioner’s claim of false implication and lack of criminal antecedents justify bail despite the seriousness of the charges.

2 12-03-2026 1. Heard learned counsel for the parties.

                                        2. The petitioner has preferred this application for

grant of regular bail in connection with Bihpur P.S. Case no.502

                   of 2021 registered under sections 498A, 494, 323, 506 and 34 of

                   Prohibition Act.

                                        3. As per the prosecution case, the informant states

          such the FIR.

                         4. Learned counsel for the petitioner submits that the

petitioner has been falsely implicated in the case. The allegation

of torture, demand of dowry and assault etc. are all false and

concocted. It was the informant who abandoned the petitioner

which led to the petitioner filing a suit for restitution of conjugal

rights under section 9 of the Hindu Marriage Act which was

registered as Matrimonial Case no.69/2021 in the Court of

                      5. The application for bail is opposed by learned A.P.P.

          for the State.

                       6. Having heard learned counsel for the parties and

taking into consideration the allegations against the petitioner in

the FIR, the submissions made on behalf of the petitioner,

pendency of the suit for restitution of conjugal rights, the

petitioner having remained in custody since 26.11.2025 and

chargesheet having been submitted in the case, the Court directs
