BAIL GRANTED

Holding

The Court ordered that all three petitioners be enlarged on regular bail in the present case.

Summary

The petitioners, Manoj Ram, Sukan Ram and Ramesh Ram, were charged in Chakia police case No. 264 of 2025 for robbery, assault with a knife, and theft of cash and ornaments. The prosecution alleged that the accused were armed, attacked an informant causing serious neck injuries, and escaped with Rs.95,000 and ornaments worth Rs.4 lakh. The petitioners contended they were falsely implicated, argued that the injuries were simple, and noted that a co-accused had already been granted anticipatory bail. Having been in custody since 24‑08‑2025 and with a chargesheet filed, they applied for regular bail under the Bharatiya Nyaya Sanhita, 2023. The High Court, after considering the FIR, injury report, and the length of detention, ordered that all three petitioners be released on bail upon furnishing a Rs.10,000 bond with two sureties each.

Issues considered

  • Whether regular bail should be granted to the accused under the Bharatiya Nyaya Sanhita, 2023 despite the seriousness of the alleged offences
  • Whether the nature of the injury to the informant warrants denial of bail
  • Impact of the six‑month pre‑trial detention and filing of the chargesheet on the bail decision
  • Effect of the co‑accused’s anticipatory bail on the petitioners’ bail application
