The Court held that the petitioners are to be released on anticipatory bail upon furnishing the prescribed bond and sureties, subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

The petitioners, five brothers from Chhaperatar, sought anticipatory bail fearing arrest in Barh P.S. Case No. 525 of 2025, which alleged offences of assault, robbery, kidnapping and extortion under several sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution’s case was based on an informant’s claim that the petitioners, armed with a pistol and lathi, attacked him, stole valuables and abducted his ten‑year‑old son demanding a ransom. The petitioners contended they were falsely implicated, asserted that the allegations were vague and omnibus except for petitioner No. 3, and highlighted the absence of eyewitnesses and any criminal record. The State opposed bail, emphasizing the specific extortion allegation against petitioner No. 3. After considering the submissions, the Court ordered that the petitioners be released on anticipatory bail upon furnishing a bail bond of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita despite the serious allegations.
  • Whether the prosecution has made specific allegations against each petitioner sufficient to deny bail.
  • Whether the lack of eyewitness testimony and the petitioners' clean criminal record justify the grant of anticipatory bail.
