The Court granted bail to the petitioner with conditions.

Summary

Principal Kumar was arrested in connection with a case registered under Sections 140(3) and 3(5) of the N.N.S. and a chargesheet under Sections 103(1), 238 and 61(2) of the B.N.S. He claimed innocence, stating that only a confessional statement obtained by police implicated him, and that he had been falsely implicated. The prosecution highlighted his criminal antecedent of nine pending cases and the confessional statement in which he admitted association with co‑accused Kare Singh. The State opposed bail on the ground of his prior record, while the petitioner argued that he had been in custody since May 2025 and that Kare Singh had already been granted bail. The Court, after considering the circumstances, ordered the petitioner to be released on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation with the trial and weekly attendance at the police station. The bail was granted despite the petitioner’s criminal antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite his criminal antecedent of nine cases and a confessional statement.
  • Whether the confessional statement alone suffices to deny bail.
