The Court held that the order dated 18‑04‑2026 shall be treated as dated 20‑04‑2026, correcting the typographical error.
Summary
The petitioner, Kanhaiya Kumar Singh, filed a criminal miscellaneous petition before the Patna High Court challenging a typographical error in Order No. 3 dated 20‑04‑2026. The order incorrectly recorded its date as 18‑04‑2026, creating a discrepancy between the hearing date and the order date. The Court examined whether such a clerical mistake warranted correction without affecting the substantive content of the order. It held that the error was purely typographical and could be rectified by treating the order as having been passed on the correct date of 20‑04‑2026. Consequently, the Court directed that the date be corrected and the order be read accordingly, with the remainder of the order remaining unchanged.
