Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the bail application, directing the petitioner to be released on bail upon furnishing the required bond and sureties.

Summary

The petitioner, Rinku Kumar, applied for regular bail in a case registered under Sections 64, 115(2), 126(2), 351(2) and 352 of the B.N.S., alleging that the informant Savita Kumari falsely accused him of establishing a physical relationship under the pretext of marriage. The petitioner claimed innocence, absence of any forceful act, and a clean criminal record, having been in custody since 24‑12‑2025. The State opposed the bail, arguing the seriousness of the offences. The Court examined the facts, the nature of the allegations, and the period of custody, and concluded that bail could be granted on condition of a Rs.10,000 bond with two sureties. Consequently, the bail application was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences under Sections 64, 115(2), 126(2), 351(2) and 352 of the B.N.S.
